Terms & Conditions

Nabaki Safaris & Tours is a trading name of the Nabaki Safaris & Tours, a company registered in the United Republic of Tanzania. The following terms as used in these Terms & Conditions shall be considered synonymous… safari, tour, itinerary and trip, all of which refer to the travel arrangements being booked with Nabaki Safaris & Tours. Additionally, the following terms: client, guest, participant, member, passenger and traveler all refer to you, as the traveler.

  1. Tour Prices quoted are valid to December 31st, 2018 and include:
  • Accommodations as indicated in each itinerary, based on either twin-bed rooms or double bed rooms (or tents where applicable).
  • Meals as indicated in each itinerary, and domestic bottled water with group meals.
  • Arrival and departure transfers and all other land transport.
  • For Kilimanjaro and other mountains: Services of professional and licensed English speaking guides (or other specified international language speaking guides), skilled cook, and enough number of porters for carrying your luggage, food, and water.
  • For safaris: Services of English speaking driver guide (or other specified international language speaking guide), and a skilled cook for camping safari.
  • Entrance fees to National Parks, game reserves and museums, and ALL other applicable fees and taxes.
  • A Safari vehicle, equipped with luxurious game viewing and touring, with a guarantee window seat!

 

  1. Not included in quoted tour prices:

Costs of passports or visas; excess baggage charges; travel insurance; airfares and airport departure taxes (unless explicitly stated); sightseeing, game drives or meals not listed in the itinerary; personal expenses such as beverages, (other than bottled water as noted in Tour Inclusions), laundry, communication charges, and gratuities.

  1. Reservations and payments:

A minimum non-refundable deposit of $750 per person is required at the time you book. The remainder of the price of your trip is due 90 days prior to your departure date. Accepted methods of payments to our booking office include check, money order, bank draft, wire transfer or credit card (Visa or MasterCard only).

  1. Cancellations:

Cancellations received by Nabaki Tours & Safaris 90 days or more prior to departure are subject to a $750 per person cancellation penalty; cancellations received 89-60 days prior to departure are subject to a penalty of 30% of the total retail tour rate; 59-30 days is 50% of the tour rate. Cancellations received 29 days or less are subject to forfeiture of 100% of the entire retail tour rate. Trip cancellation insurance is strongly recommended.

  1. Guest representation and consent:

The person making a booking with Nabaki Tours & Safaris, warrants that; he/she has authority to enter into a contract on behalf of all other persons included in such a booking. The payment of the deposit or any other partial payment for a reservation on a tour constitutes a consent by all guests covered by that payment to all provisions of the Terms and Conditions contained herein whether the guest has signed the contract or not.

  1. Participation:

Persons not fit for long trips due to heart disease, chronic illness, physical handicap, advanced pregnancy or mental illness should not participate in these rigorous travel programs.

  1. Alterations to tours:

Nabaki Tours reserves the right to alter or modify the itinerary of any tour, if air schedule or surface transportation changes, security matters and/or events beyond its control make such alterations necessary.

  1. Specific accommodations:

Accommodations and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances Nabaki Tours control. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued.

  1. Special requests:

Specific requests such as connecting or adjacent rooms, smoking or non-smoking rooms and special dietary needs should be advised at time of booking. Please be advised that every effort will be made to secure your special request; however, they cannot be guaranteed.

  1. Baggage:

Baggage and personal effects are at owners risk throughout the tour. Luggage weight restrictions on some internal flights may apply; details will be provided on your itinerary.

  1. Photography:

Nabaki Tours may take photographs or film of its trips and trip participants, and participant grants Nabaki Tours & Safaris express permission to do so and for Nabaki Tours to use such for promotional or commercial use.

  1. Departures date and price:

These tours are scheduled to operate through December 31, 2019. Prices shown herein are based on tariffs, exchange rates and airfares in effect on January, 2017; and Nabaki Tours reserves the right to alter prices quoted should inflation, costs of fuel, labor or material, air fares or foreign exchange rates change.

  1. Claims and refunds:

Except for verifiable extenuating circumstances, refunds are not made for any missed tour services. There will not be any refund if you cancel the tour that is in progress. Please see our Limits on Responsibility. For verifiable claims to be considered, they must be received in writing within 45 days of the termination of the tour and be accompanied by supporting statement from the Tour Operating Company verifying the claim.

  1. Nabaki Safaris & Tours’s responsibility:

Nabaki Safaris & Tours, its employees, shareholders, officers, directors, successors, agents and assigns (collectively Nabaki Safaris & Tours ), does not own or operate any entity which is to or does provide goods or services for your trip, including, for example, lodging facilities, transportation companies, local ground or safari operators, including, without limitation, various entities which may be affiliated with Nabaki Tours and/or which may utilize the Nabaki Tours name, guides, food and drink service providers, equipment suppliers, etc. As a result, Nabaki Tours is not responsible for any negligent or willful act or failure to act of any person or entity it does not own or control, nor for any act or inaction of any other third party not under its control.

In addition and without limitation, Nabaki Safaris & Tours is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, disease, illness, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, overbooking or downgrading of accommodations, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

  1. Arbitration agreement:

Any controversy or claim arising out of or relating to these Terms and Conditions, to the limits on Nabaki Safaris & Tours ’ responsibility clause, to the brochure, to the flier, to any information relating in any way to the trip, to the trip itself, or to any products or services related to the trip, shall be settled solely and exclusively by binding arbitration in Tanzania, in accordance with the Commercial Arbitration Rules of the Tanzania Arbitration Association, except that (a) in lieu of a personal appearance at arbitration, the arbitration may be conducted by telephonic means, (b) arbitration is the exclusive forum for dispute resolution (no court actions), and (c) except as otherwise provided by statute, each party shall bear its own costs and expenses and an equal share of the arbitrator and administrative fees.

  1. Risks:

There are certain inherent risks in adventure travel of the type involved here. These include, but are not limited to, risks of white water rafting, kayaking and rafting (for example dangers of rapidly moving water, rocks and other submerged objects, hypothermia,), horseback riding, (for example, unpredictable behavior by the horses, being spooked) hiking, climbing mountains (for example, rock slides, falling stones), walking safaris, downhill or cross country skiing, (for example, equipment failures, ice or other trail obstructions) and in all trips dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Traveler assumes all such risks with regard to these possibilities.

ANY PAYMENT TO NABAKI SAFARIS & TOURS ESTABLISHES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS SET OUT HEREIN.

Nabaki Safaris & Tours recognizes the importance of privacy and the sensitivity of personal information.

To ensure accountability, Nabaki Safaris & Tours has instituted this policy, and trained our professionals of our policies and practices.

This document explains how Nabaki Safaris & Tours uses and including what type of information is gathered, how the information is used and for what purposes, to whom we disclose the information, and how we safeguard your personal information. We hope this will help you make an informed decision about sharing personal information with us.

  1. Why do we need personal information?
    Nabaki Safaris & Tours collects your personal information in order to facilitate your travel to Tanzania and East Africa in general.
    2.  What the information we collect?

We collect information that can identify you, including your first and last  name, telephone number, postal and e-mail addresses, when you book activities using our online activity desk, send requests, or otherwise voluntarily provide such information (for example, we may ask for your personal information when you’re discussing a service issue on the phone with our tour consultant).

3.  How we use your information?
Nabaki Safaris & Tours only collects the personal information necessary to fulfill the purposes identified to you prior to or at the time of collection, or any other reasonable and legitimate purposes or as required by law.

Nabaki Safaris & Tours does not, as a condition of supplying a service to you, require consent to the collection, use or disclosure of personal information beyond that reasonably required for such purposes, or to comply with our obligations under applicable law.

  • Nabaki Safaris & Tours usually collects and uses your personal information for the following purposes:
    Collecting, recording and using the information relevant to the performance of the services rendered to and for you
  • Administration, billing, accounting and collection in relation to your business and relationship with us
  • Protecting against fraud and error
  • Providing direct marketing materials to you regarding our services
  • Communicating with you generally or to ensure your satisfaction, and
  • Communicating the information to a sub-contractor or supplier, such as hotel/lodges, (or other agents or intermediaries) in the course of a contract or mandate for the performance of any of the purposes listed above Nabaki Safaris & Tours does not disclose your personal information to any third party to enable them to market their products and services without your consent. For example Nabaki Safaris & Tours does not provide our client mailing lists to other tour operators. Nabaki Safaris & Tours ensures that third parties which are engaged to perform services on Nabaki Safaris & Tours behalf and are provided with personal information are required to adhere the intent of this Privacy Policy by having comparable levels of security protection or, when required, by ensuring us (through a confidentiality agreement) that they will not use or disclose the personal information for any other purpose that for which the personal information was communicated.
  1. Is my personal information secured?
    Nabaki Safaris & Tours takes all reasonable precautions to ensure that your personal information is kept safe from loss, unauthorized access, modification, or disclosure. The steps taken to protect your information are:

* restricted file access to personal information
* deploying technological safeguards like security software and firewalls to prevent   hacking or unauthorized computer access
* internal password and security policies

  1. Changes to this Privacy Policy
    Nabaki Safaris & Tours may update this policy from time to time. We will not reduce your rights under this policy without your explicit consent, and we expect most such changes will be minor. Regardless, we will post any changes to our client(s) and, if the changes are significant, we will provide a more prominent notice.

General legal terms
These Terms and Conditions, and your relationship with Nabaki Safaris & Tours, shall be governed by the law of the Tanzania government. You and Nabaki Safaris & Tours. Agree to submit to the exclusive jurisdiction of the courts of the Tanzania government to resolve any legal matter arising from the usage of Nabaki Safaris & Tours services.
